This End User License Agreement ("Agreement") is a legal agreement between you (either an individual or an entity) ("Licensee" or "you") and Andrey Stepanov ("Company," "we," "us," or "our") for the use of the “Simple PlantUML for Confluence” application ("Application"). By installing, accessing, or using the Application, you agree to be bound by the terms of this Agreement.

License Grant

Subject to the terms of this Agreement, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Application for your internal business purposes. This license does not convey any ownership rights in the Application or any of its components.

Restrictions

Licensee shall not:

  • Modify, adapt, translate, reverse engineer, decompile, or disassemble the Application.

  • Rent, lease, loan, sell, sublicense, distribute, or otherwise transfer the Application to any third party.

  • Use the Application for any illegal purpose or in a manner that violates any law or regulation.

Ownership

The Application is licensed, not sold. We retain all right, title, and interest in and to the Application, including all intellectual property rights. This Agreement does not transfer any ownership rights to Licensee. All rights not expressly granted to Licensee are reserved by the Company.

Privacy and Data Collection

We may collect and use data as described in our Security and Privacy Policy, which is incorporated by reference into this Agreement. The Application does not store any personal data. Any data processed by the Application is used solely for immediate functionality and is not retained.

Limited Warranty and Disclaimer

The Application is provided "AS IS" and "AS AVAILABLE" without any warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Application will meet Licensee's requirements, be error-free, or operate without interruption.

Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) Licensee's use or inability to use the Application; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iii) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our Application by any third party; or (iv) any errors or omissions in any content or for any loss or damage incurred as a result of Licensee's use of any content made available via the Application, whether based on warranty, contract, tort (including negligence), or any other legal theory, and whether or not we have been informed of the possibility of such damage.

Indemnification

Licensee agrees to indemnify, defend, and hold harmless the Company, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with Licensee's access to or use of the Application.

Termination

We may terminate or suspend Licensee's access to the Application immediately, without prior notice or liability, for any reason whatsoever, including without limitation if Licensee breaches the terms of this Agreement. Upon termination, Licensee's right to use the Application will immediately cease.

Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law principles. Any disputes arising out of or in connection with this Agreement shall be submitted to the exclusive jurisdiction of the courts located in Haarlem, North Holland, the Netherlands.

Severability

If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

Entire Agreement

This Agreement constitutes the entire agreement between Licensee and us regarding the use of the Application and supersedes all prior agreements and understandings, whether written or oral, relating to the subject matter of this Agreement.
